Home Information Pack Contents
The Regulations provide that the Home Information Pack must
include (regulation 8):
(a) a Home Information Pack Index complying with Schedule 1
(b) a Sale Statement complying with Schedule 2
(c) for registered land an official copy of the register
title plan
(d) for unregistered land a certificate of an official search
of the index map and other documents necessary to deduce title
(e) for commonhold property (Schedule 3):
- an Official Copy of the Register and Title Plan relating to
the common parts
- the Commonhold Community Statement
- the Memorandum and Articles of Association of the
Commonhold Association
- the names and addresses of management
- regulations or rules made by the commonhold association or
management
- amendments proposed to the above
- a summary of current or planned works affecting the
commonhold
- recent requests for payments of commonhold assessment,
reserve funds and insurances
(f) for leasehold property (Schedule 4):
- a copy of the Lease
- the names and addresses of the landlord and management
- landlord/management's regulations or rules
- memorandum and articles of association of
landlord/management company
- amendments proposed to the above
- statements or summaries of services charges
- a summary of current or planned works
- recent requests for payment or financial contributions
towards service charges, ground rent and insurances
(g) for sub-divided property, leases or licences to which the
houses are (to be) subject but are not included under (f)
(h) for property that is physically complete, a Home
Condition Report complying with Schedule 5 or a New Homes Warranty complying
with Schedule 6 plus cover note
(i) where appropriate, a New Homes Warranty complying with
Schedule 6
(j) other Home Condition Reports complying with Schedule 5
completed in the previous 12 months
(k) if the property is physically complete, an Energy
Performance Certificate for the property if there is no Home Condition
Report or the EPC is dated later than the HCR
(l) if the property is not physically complete, a Report on a
Home Not Physically Complete complying with Schedule 7
(m) a Local Land Charges search report
(n) a Local Enquiries report complying with Schedules 8 and 9
(o) a Drainage and Water Enquiries Report complying with
Schedules 8 and 10
The home information pack may also include other authorised
documents (listed in reg 9), but must not include any others.
Note that the Home Use Form and the Home Contents Form, which were
obligatory under the Draft Regulations, are now optional, authorised under
reg 9.
Home Information Pack Forms
The ODPM consultation exercise on the draft regulations in October 2005
included forms which were proposed should be required elements of the Pack.
These forms included:
- Home Information Pack Index
- Sale Statement
- Report on a Home not Physically Complete
- Home Use Form
- Home Contents Form
These forms are not included in the Regulations as they are
subject to further consultation during the dry run period. The Regulations
do do require an Index (Schedule 1) and a Sale Statement (Schedule 2), and
in certain instances a Report on a Home not Physically Complete (Schedule
7). While the format of these documents is not prescribed, they must contain
the prescribed information, and the DCLG forms can be used to fulfil these
requirements. DCLG have also prepared a Home Contents Form and a Home Use
Form, both of which are optional authorised documents. |
